Do I Need A Lawyer For Child Support?

The short answer is no - in Virginia you do not need a lawyer to represent you, process, file or finalize your child support matter.  There is no rule or law saying that you do.  If one wants to file their divorce without a lawyer that is called being pro se.

There are advantages to having a lawyer represent you.  

First, a competent child support lawyer should know the process.  Like a sporting event or a board game, there are rules and procedures that need to be followed.  If you do not know those, then the outcome and results could be much worse than you desire.  

Second, knowing what the law is helps get you the outcome most beneficial to you.  A competent child support lawyer can help guide you through the process as well as the trial helping to manage expectations and trying to make sure that you are treated fairly.  

Lastly, an experienced child support attorney can guide you through the process so that you know what to expect as well as help manage your expectations by letting you know what is realistic and what is not.

Brian took a case that another well known attorney said was impossible to win. Not only did he win that case, but he also got several show causes dismissed. On our scheduled court date we had two additional show causes that were never served, however, Brian got them dismissed without having time to prepare. About Child Support

We will be the first ones to tell you that you should not believe half of what  your read on the Internet.  When it comes to doing your own reseach on child support in Virginia we encourage you to use the Internet to get some foundations.

The problems are two-fold.  First, you do not know who wrote the article/post.  Even if it is on the page of a law firm in Virginia holding themselves out as child support lawyers that does not mean a competent child support lawyer wrote the article or even proofread the article.  In fact, many firms outsource those articles.  Here, I write our own articles/posts on various aspects of divorce, separation, custody, visitation, etc., and have them proofread by someone else in the office before they are posted.

Second, each case is unique.  There is no "one size fits all" child support or articles on child support.  Each case should be approached on its own fact pattern and handled accordingly.  Articles and posts should be designed to be generic and informative but not legal advice.

Where Do We Go?

Brian is licensed in all of the state courts of the Commonwealth of Virginia.  We handle cases in various Circuit Courts, General District Courts, and Juvenile & Domestic Relations Courts all over the state.

The Child Support Process

The child support process is not terribly complicated.  There are, essentially, two procedures but one has a little twist.  I will quickly give you an overview of the process.

There is what is called an admiinistrative procedure.  This is done by the Division of Child Support Enforcement.  Either party can open a case with them and have child support managed through that office.  It is a "free" service for child support, however, the payor may have additional fees each month for processing.  If an Order for child support is done this way it still has the same effect as if it was entered by a Court.

The second procedure is somewhat of a two-part child support procedure.  This involves going to Court to get a Court Order for child support.  At first the Court will probably send you to mediation to see if you can work something out.  This is always preferable because it gives control to you rather than the Court.  If that does not work, then you will be sent to the Judge for a determination of your child support.
