Brian took a case that another well known attorney said was impossible to win. Not only did he win that case, but he also got several show causes dismissed. On our scheduled court date we had two additional show causes that were never served, however, Brian got them dismissed without having time to prepare. What stood out the most with Brian and his office was their response time. It was either same day or soon after, which is pretty unheard of with most lawyers. We will be the first ones to tell you that you should not believe half of what  your read on the Internet.  When it comes to doing your own reseach on divorce, separation, custody, visitation, child support, or spousal support in Virginia we encourage you to use the Internet to get some foundations.  The problems are two-fold.  First, you do not know who wrote the article/post.  Even if it is on the page of a law firm in Virginia holding themselves out as divorce lawyers that does not mean a competent divorce lawyer wrote the article or even proofread the article.  In fact, many firms outsource those articles.  Here, we write our own articles/posts on various aspects of divorce, separation, custody, visitation, etc., and have them proofread by someone else in the office before they are posted.  Second, each case is unique.  There is no "one size fits all" divorce or articles on divorce.  Each case should be approached on its own fact pattern and handled accordingly.  Articles and posts should be designed to be generic and informative but not legal advice.

About Child Custody Law In Virginia

Do I have to Court to get custody?

In Virginia, a "parent", whether biological or adopted, stands on equal footing as the other parent. So both have the same custody rights. This can be a plus and a minus.​ It means that you do not have to go to Court because each of you has custody. It also means that, without a custody Order, either parent can keep the other parent away from the child.

What is legal custody?

Legal custody is decision-making abilities. When someone talks about legal custody of a child, that means the ability to be involved with and make decisions regarding education, medical treatment and religious training. While this is an oversimplification, hopefully it answers the question.​

What is a physical custody?

Physical custody of a child is where he or she physically resides. The phrase usually refers to where a child or children reside at least 50% of the time.

What is child custody or custody?

Child custody, often just called custody, refers to legal decisions and residency of a child. It is composed of two parts - legal custody and physical custody. One can have legal but not physical custody or both.​

When it comes to child custody in Virginia, it is not a matter of whatever the Judge wants or feels like doing under the circumstances.  It is a matter of the Court following the laws established by the Code of Virginia.  Here are some links to those laws so that you can have a foundation for any questions.
